Terms
The short version
- Darthouse is free today. We can’t promise it always will be, and optional purchases may come later.
- You must be 16 or older.
- We have no tolerance for objectionable content or abusive players. Keep your name clean and your camera on the board. You can report and block anyone, and we can ban anyone.
- Scores come from a camera and can be wrong. Darthouse is for fun. Don’t rely on it for bets or anything official.
- The app comes as it is, without guarantees, and our liability is limited as far as the law allows.
Who you’re agreeing with
These terms are between you and Lumenware LLC (“we”). You can reach us at support@darthouse.app.
By creating an account or using Darthouse, you agree to these terms. If you don’t agree, don’t use it. The privacy policy explains what we do with your data.
Free, for now
Darthouse costs nothing today. We don’t promise it will stay free or that every feature will stay. Optional purchases may come later, such as a way to support the game or cosmetic items. If they do, they’ll be sold through Apple’s in-app purchase, and Apple’s terms will apply to them. We’ll show the price before you pay. You’ll never be charged without choosing to buy something.
Your account
- You need an account to use Darthouse, and you sign in with your email and a 6-digit code.
- You must be 16 or older, and old enough where you live to agree to these terms. By ticking the box at sign-up, you’re telling us that’s true.
- One person per account. Keep access to your email safe, as anyone who can read it can sign in.
- You’re responsible for what happens on your account.
Rules for playing
We have no tolerance for objectionable content or abusive users. You must not:
- Use a name that’s hateful, sexual, abusive, threatening, or pretends to be someone else or us. The filter won’t catch everything, and passing it doesn’t make a name allowed.
- Harass, threaten, bully or try to frighten other players.
- Show anything on your board camera except your board and normal play. That means no nudity or sexual content, no violence, no hateful symbols or gestures, and no drugs or weapons being shown off. Darts in play are fine.
- Point your camera at people who haven’t agreed to be on it, or use it to show private things.
- Film, screenshot or share another player’s video or photos to embarrass or harm them.
- Do anything involving children and sexual content. We report this to the authorities.
- Cheat, including faking scores, changing the app, or fixing darts you know were right.
- Attack, overload, copy or reverse engineer the service, or get around a ban.
- Use Darthouse for anything illegal.
The people around you matter too. If someone’s in the room while your board’s on camera, let them know. Stay clear of the board while darts are being thrown, keep your phone or iPad out of the way of the darts, and look after your own kit. Darts are sharp. Play at your own risk.
Live board video and photos
In online games, others see a flattened view of your board while it’s your throw: moving video in games with friends, and photos in games from Find a match. Anything between the camera and the board can show up. We don’t watch games as they happen, and we don’t record them. The privacy policy has the details.
Reporting and blocking
- Report a player from their profile, or during or after an online game. Pick a reason, including “Offensive name” or “Something inappropriate on camera”. We review reports within 24 hours.
- Block a player the same way. Neither of you can find the other in search, they can’t send you friend requests, invite you or open your profile, neither of you can join a room the other’s in, and Find a match won’t put you together. They aren’t told. A game you’re already in carries on. You see a drawn board instead of their camera, and the score stays live. They still see your board when it’s your throw. There’s no rematch afterwards.
- Report something urgent or serious by email to support@darthouse.app. If someone’s in danger, call your local emergency number first.
Reporting a wrong dart is different. It helps improve scoring and can correct a local game. It never changes the result of an online game.
What we do about it
We can remove or change a name, end a game, restrict your account, or ban you, with or without warning, if we reasonably think you’ve broken these terms or put others at risk. We can also report things to the police. A ban signs the account out on every device and takes it out of any game it’s in. After that, signing in only shows that it’s been banned, so it can’t be used to play, though you can still get a copy of your data or delete the account. If you think we got it wrong, email support@darthouse.app and we’ll take a look.
Your content
Your name, your games and your video and photos stay yours. You give us a worldwide, free licence to store, copy and show them to other players as far as we need to run Darthouse. This ends when the content is deleted, apart from the things the privacy policy says stay. If you say yes to Help improve scoring, you also let us use the pictures and details it sends to train and test our scoring models, and the models we’ve trained can keep being used after that. You can turn it off in Settings.
Only upload or stream things you have the right to, and don’t show other people without their agreement.
Scores are for fun
Darthouse scores darts with a camera, and sometimes it’ll be wrong. Fix a dart and Undo are there for this, and results, stats and averages are only as good as what the camera and players recorded. Don’t rely on them for prize games, bets, or official results. Local and online games count towards your stats, and we may rework stats when the rules or scoring improve.
The app, Apple and these terms
Apple’s Licensed Application End User License Agreement is the licence for the app itself. These terms add the rules for the Darthouse service. If the two conflict over the app’s licence, Apple’s agreement wins. You also have to follow Apple’s own terms and any other third-party terms that apply to you.
You agree that:
- These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- Apple has no duty to provide maintenance or support for the app.
- Any claim about the app, such as product liability, legal compliance, consumer protection, privacy or intellectual property, is ours to deal with and not Apple’s.
- You aren’t in a country under a US embargo, or one the US names as supporting terrorism, and you aren’t on a US list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and can enforce them against you.
Darthouse, its art, models and code belong to us or our licensors. We give you a personal, non-transferable licence to use the app on Apple devices you own or control. Open source parts of the app come with their own licences.
No guarantees
We provide Darthouse “as is” and “as available”. As far as the law allows, we give no guarantees that it will be accurate, always available, free of bugs or fit for any purpose. Features can change or stop. Games, stats and items could be lost. Other players’ behaviour isn’t our responsibility, though we’ll act on reports.
Limits on what we owe you
As far as the law allows, we aren’t liable for indirect or knock-on losses, lost data, lost profits, or anything you lose on a game’s result. Our total liability to you for anything to do with Darthouse is limited to the greater of what you’ve paid us in the last 12 months or 50 US dollars.
Nothing in these terms limits liability that can’t legally be limited, including for death or personal injury caused by negligence, or for fraud. If you’re a consumer in the UK or EU, you keep your mandatory legal rights.
Ending things
You can stop at any time by deleting your account in Settings, then Account. We can suspend or close your account under What we do about it. We can also stop running Darthouse, and if we do we’ll try to tell you first. After an account ends, these terms still apply to anything that happened before, and the sections on content, guarantees, liability and law carry on.
Changes to these terms
We may change these terms. If it’s a real change, we’ll ask you to read and agree to the new version in the app before you carry on playing online. Local games work either way. If you don’t agree, you can delete your account.
Law and disputes
These terms are governed by the law of the US state where Lumenware LLC is registered. If you’re a consumer, you can also rely on the mandatory protections of the country you live in, and bring a claim in its courts. Please talk to us first, as most things can be sorted out by email.
